Full Definition of Terms & Conditions

In the event of any discrepancy between VDub Adventures and the hirer these and any other VDub Adventures literature, the provisions of these Terms and Conditions apply. By hiring one of our campervans, you are effectively accepting these terms and conditions.

‘VDub Adventures’ means VDub Adventures owned by Graeme Smith sole trader, 3 Cairntradlin Cottar, Kinellar, AB21 0SA the Owner.

‘DRIVER / HIRER’ means the person(s) nominated as the driver(s) under the RENTAL AGREEMENT and any Customer.

‘CAMPER / VAN / CAMPERVAN / VEHICLE’ means the vehicle under hire as described under the heading ‘Vehicle Details’ under the ‘Rental Agreement’ and includes tyres, tools, accessories, living equipment and any other special equipment, documents relating to the vehicle and any replacement or substitute vehicle provided by VDub Adventures.

‘RENTAL AGREEMENT’ means the document read and signed by the hirer on collection and return of the vehicle. It includes details of ‘Driver/Hirer’, ‘Vehicle Details’, ‘Hire Period’, ‘Vehicle Condition Report’.

‘DAMAGE’ - Charged at actual cost of repair plus an appropriate labour charge to arrange the repair – receipt for repair will be available on request.

Excluding any insurance loading, extra charges may be incurred if the driver to be insured has a traffic conviction, holds a driving licence from a non-EU country or is in an occupation which is deemed high risk. These charges will be passed onto the customer.

1. HIRER / DRIVER AGE LIMITS

·         Driver(s) must hold a valid full UK or EU driving licence for at least 24 months.

·         All Drivers must be present for collection of the Vehicle. No exceptions can be made.

·         On the day of your hire collection, please provide all the necessary documentation for your insurance cover (your licence photocard, Passport & two utility bills to confirm your address).

·         We also require a DVLA Driver check code. If you have a Northern Ireland driving licence, we require both the photocard and the paper counterpart.

·         You must declare at the time of booking if there are any endorsements on your driving licence. We may not be able to provide cover for some endorsements. Charges apply for penalty points.

·         Failure to declare an accident or driving conviction invalidates any insurance cover for the hire.

·         Drivers holding only an automatic driving licence are not permitted to drive any of our campervans.

·         Should any Driver fail to present all of the correct documentation and identification on collection of the vehicle or the documentation does not meet the Driver requirements set out in these terms and conditions, then VDub Adventures will be unable to release the vehicle and no refunds will be given.

·         Drivers must be over 21 and under 78.

·         Drivers must not have had their licence suspended for any period within the last three years.

·         Drivers must not have been involved in more than one fault incident within the last three years.

·         Drivers must not have more than two convictions with a maximum of 3 points per conviction.

·         Drivers must not have obtained a BA, DD or UT conviction.

·         The milage allowance is 125 miles per day, the rate over and above this is 0.80p per mile.

 2. INSURANCE

·         Fully comprehensive insurance is provided by VDub Adventures through our insurers to the Driver(s) named on the Rental Agreement. The vehicle is insured for damage to the vehicle and the property of a third party but does not include any personal insurance for the customer including death or bodily injury or passengers to the driver nor does it cover any personal possessions.

·         Only persons named on the Rental Agreement are insured to drive the vehicle.

·         In the event of an accident the hirer will have to pay the insurance excess of £750.

·         The excess will be £2500 to £4000 for any US, Canadian or South African Drivers.

2a. ADDITIONAL INSURANCE CHARGES

·         Insurance for an additional Driver is charged additionally per day. Only one additional Driver is permitted.  There will be a fee for additional Drivers.

·         Insurance for Driver(s) aged over 70 years to 74 years is charged additionally per day.

·         Additional insurance charges may apply if the Hirer has an occupation that is deemed to be high risk.

·         Additional insurance charges may apply if the Hirer holds a non-EU driving licence.

2b. INSURANCE EXCLUSIONS

Examples include:

·         Any call out charges necessitated by the client through operator error, e.g. a flat vehicle battery etc will be the responsibility of the client.

·         The theft of a camper will not be covered by insurance if the ignition keys are left in or on the vehicle whilst unoccupied and the hirer shall be held fully responsible for a replacement vehicle.

·         Please note that no insurance is offered for damage to the pop-up roof of any vehicle and any damage is deemed as gross negligence. Therefore, the Hirer accepts full liability for these, the Hirer shall be responsible for any such liability in addition to the standard excess of the vehicle should that apply.

·         Windscreen, mirrors and/or tyre damage is not covered by the standard vehicle insurance.

·         Please note VDub Adventures do not accept liability for injury, loss, death that might incurred to anyone in the camper or customer hiring the camper or using any equipment.

·         VDub Adventures do not take any responsibility in the event of any accidents or any fault of any equipment when out on hire.

·         No other hire insurance is acceptable for the rental of a VDub Adventures camper.

3. SECURITY DEPOSIT

The security deposit is £250.

The security deposit must be paid at the point of booking.

This can be by bank transfer (details on the booking form) or by card over the phone or paypal. When you pay the balance of your hire fee, your card details act as security in the event of damage sustained on hire.

‘DAMAGE’ - Charged at actual cost of repair plus an appropriate labour charge to arrange the repair – receipt for repair will be available on request.

If Damage involves an insurance claim, the excess will be payable, plus a labour charge to administrate and arrange the claim. Typically, this will involve:

·         you describing the incident while we make the claim;

·         taking the vehicle for inspection to repair body shops;

·         taking the vehicle back to base;

·         booking the vehicle in for the repairs; and

·         then taking it back for repair and having it off the road for the duration of the repair,

 This all takes time and needs to be covered, but we will be as fair as we can.

Please take care of everything and treat it as you would your own belongings. Please be honest if you damage the van. We understand that accidents happen, but we must be be notified if there have been any incidents whilst on hire as soon as reasonably possible.

VDub Adventures retains the right to use the security deposit to fund any:

·         loss or damage whatsoever to equipment, fixtures, fittings, windows, cleaning fees, tyres or negligent damage to the vehicle; or

·         any cleaning fees, the damage administration fee or road traffic violation administration fees.

Please Note - The Insurance Excess is £750 pounds for UK drivers, and may be more for other nations. The hirer agrees to pay VDub Adventures any additional costs over and above the security deposit value should damages exceed the security deposit value.  This should be paid within 28 days of your hire.

VDub Adventures retain the right to hold the Hirer’s bank details on file while the van is out on hire.

The hirer irrevocably and unconditionally authorises VDub Adventures to deduct from the security deposit any amounts due to VDub Adventures arising out of this agreement.

The security deposit does not cover cost for replacement or repair of, aerials, glass, wheels, roof, underside of vehicle, windscreen, wing mirror, tyre damage or incorrect refuelling (eg: putting petrol into diesel tank) for which the hirer is responsible.

Vehicles must be returned with the same fuel level as at the start of the hire. If the campervan is returned with less fuel, VDub will refill it on your behalf and deduct the cost of fuel plus a refuelling service charge from your security deposit. Only the correct fuel type may be used. Any damage caused by misfuelling will be the renter’s responsibility.

The Hirer is responsible for the safe keeping of all vehicle keys throughout the hire period.  If keys are lost, stolen, or damaged, the full cost of replacement will be deducted from the security deposit. This may include:

·         Key replacement or reprogramming

·         Locksmith call‑out fees

·         Vehicle recovery if required

If the total cost exceeds the security deposit, the renter will be liable for the remaining balance. VDub will provide an itemised breakdown of any charges applied.

VDub Adventures reserves the right to increase the security deposit for specific events eg: festivals or rallies.

A cleaning fee of £60 will be charged against the security deposit if the vehicle is not returned with the interior in a satisfactory clean condition.

4. PAYMENT

A reservation is only binding once the booking is confirmed by VDub Adventures by email and a deposit has been paid.

Settlement of the remaining balance of the hire fee will be due prior to departure as stipulated by VDub Adventures.  This will normally four weeks in advance of departure.

For late bookings (within four weeks of departure date or less), the full amount of the hire fee will be payable on booking. Vehicles will not be released without full payment being completed.

 4a. HIREABLE EXTRAS

Other hireable extras available for the duration of hirers’ stay in a VDub Adventure camper include: Outdoor Chair, Awning ,Bike Rack. Please see booking form for prices.

The security deposit applies not only to the vehicle but also to any additional items or accessories booked as part of the hire. If any additional items are lost, damaged, or not returned, the cost of repair or replacement will be deducted from the security deposit.  If the total cost exceeds the security deposit, the renter will be responsible for the remaining balance. An itemised breakdown of any deductions will be provided.

5. COLLECTION AND RETURN

Collection and return of the CAMPER will be to a location agreed and specified at the time of booking as set out under ‘hire period’ in the booking form.

Alternative collection / return locations will be considered on request, however, additional charges may apply.

On collection, please allow 30 mins to complete the documentation, collection and demonstration of vehicle. The Vehicle will be handed over in a clean condition and in sound working order in accordance with the ‘Vehicle Condition Report (VCR)’.

All drivers must be present on collection of the Vehicle and must present their full valid driving licence, passport, DVLA Code and two utility bills to confirm your address. Photocopies will not be accepted.

Late Return – We must be notified immediately to prevent any prosecution for driver(s) driving whilst uninsured. Late returns will be charged at one day’s rental cost regardless of circumstances.

It is the Hirer’s obligation to ensure that there are no personal belongings left in the vehicle before returning it.

6. CANCELLATION BY VDUB ADVENTURES

VDub Adventures reserve the right to cancel a reservation before, at the proposed commencement of hire, or during the hire as follows:

·         If Named Driving Licence is not produced or valid in accordance with stated conditions.

·         Hirer fails to provide funds for security deposit payment (standard excess) by credit card or debit card.

·         Over occupancy of vehicle in accordance with the provision of seatbelts.

·         The Address on driving licence does not match billing address. Additional proof of id is required

·         Hirer does not provide a valid passport and driving licence as proof of ID.

·         Due to operational issues affecting rental fleet.

·         Hirer is in breach of any term in this agreement.

·         The hirer obtained the vehicle through fraud or misrepresentation.

·         If any statement, representation or warranty made by the hirer in respect to himself or additional drivers is incorrect.

·         The vehicle appears to be abandoned.

·         The vehicle is not returned at the agreed date or if we believe the vehicle will not be returned on the agreed return date.

·         VDub Adventures considers on reasonable ground that the safety of passengers or the vehicle is in danger. The hirer understands that in the event of such termination or repossession that the hirer has no right to a refund or any part of the rental charges or the security deposit.

·         VDub Adventures liability is limited to the refunds of all monies paid by the hirer. No compensation is available for additional arrangements booked by hirer (eg: flights, concert tickets).

·         VDub Adventures reserve the right to amend our cancellation policy for certain events.

·         The vehicle requires repair, or fault with Campervan

·         In the event of an accident the van is required to be fix with the hire period and returned, no refund is given for days lost by the hirer.

·         The hirer is required to return the van in the same condition it when out and pay for any damages occurred.

When on hire, hirer is responsible for replacement/repair of any tyres/wheels before continuing journey.

VDub Adventures reserve the right to refuse to hire to any person, without stating cause.

7. CANCELLATION BY HIRER

In the event of a cancellation by the hirer the following charges shall be incurred:

·         3 weeks prior to rental to no show: 100% of total hire charge and deposit will be retained.

·         6 weeks to 4 weeks prior to rental: 70% of deposit will be retained.

·         More than 6 weeks prior to rental: 40% of deposit will be retained.

Customers are advised to check their own travel insurance policy in the event of a cancellation by the hirer.

8. CAMPERVAN SYSTEMS

VDub Adventures will carry out a full pre-rental inspection of the vehicle before the commencement of hire.

At collection, the hirer will be demonstrated the vehicle and shown how each system works. Should an onboard system fail during the hire, VDub Adventures will make every effort to remedy the fault whilst you are out on rental but in some circumstances, this may not be possible.

VDub Adventures cannot be held responsible and will not refund any monies should a loss of service be encountered nor have any obligation to provide a replacement vehicle.

In the case of winter hire, VDub Adventures cannot be held responsible in the event of any damage or inconveniences caused by freezing conditions. This is the responsibility of the hirer.

A camping gas canister will be included in the rental and provided on collection. Only customers who have pre-paid for gas will receive a full canister of camping gas. Additional gas purchased throughout the rental period is at the customers own expense.

Smoking: Smoking is not permitted in any Camper vehicle. We reserve the right to impose additional cleaning charges should smoke be detected in the vehicle.

Pets: The Hirer acknowledges that any damage, repair costs or extra cleaning costs caused because of, or by, a pet travelling in the vehicle must be paid for in full by the Hirer.

9. DRIVING IN MAINLAND EUROPE

We must be notified if planning travel to Mainland Europe as there is an additional charge for European insurance cover.

10. USE OF THE CAMPERVAN

The CAMPERVAN is:

·         not to be driven otherwise than in a cautious, prudent and normal manner;

·         used in a manner which could cause damage;

·         driven in a prohibited area or in an area other than the areas indicated by me to VDub Adventures;

·         driven by a person under the influence of alcohol or drugs or with a blood alcohol level in excess of that permitted by law;

·         left with the ignition key in the vehicle while it is unoccupied;

·         left unoccupied without; valuables concealed;

·         driven by persons under the age of 24 years or who is not authorised by law to drive the Vehicle or named in the agreement;

·         damaged by submersion in water;

·         put into contact with Salt Water;

·         used for any illegal purpose for any race, rally or contest;

·         used to tow any vehicle or trailer not authorised in advance by VDub Adventures;

·         used to carry passengers or property for hire or reward;

·         used to carry more persons than is permitted by any relevant authority or detailed in the Vehicle manual or on the Vehicle or specified in this agreement;

·         used to carry volatile liquids, gases, explosives or other corrosive or inflammable material;

·         or otherwise used in breach of the Hirers obligations under this Agreement.

Alterations to the Vehicle

The Hirer shall not make any alterations or additions to the Vehicle without the prior written consent of VDub Adventures.

11. RESPONSIBILITY WHEN AN INCIDENT/ACCIDENT OCCURS

In the event of any accident, loss or damage arising out of the use of vehicle including damage to a third party vehicle, the hirer will notify VDub Adventures, as soon as possible, and within 24 hours of the event and:

·         Obtain the names and address of third parties and any witnesses and report the event to the nearest police station.

·         Complete the incident reporting form supplied.

·         Assist VDub Adventures in handling any claim arising from the event.

·         Acknowledge that the excess or other amount due in respect of any damage arising from an accident, loss or damage is payable at the time of reporting the event and not at the completion of the rental period, regardless of which party is at fault.

·         Accept that no security deposit/excess will be refunded until the claim is settled.

·         Depending on the damage, return the van prior to end of hire to enable appropriate repairs to be carried out.

11a. INCIDENT REPORTING

If any damage, accident, theft, or incident occurs during the hire period, the renter must complete an Incident Report Form provided by VDub.  The form must be completed as soon as reasonably possible, and no later than 24 hours after the incident, unless circumstances prevent this.

The Hirer must provide:

·         A clear description of what happened

·         The date, time, and location of the incident

·         Details of any third parties involved

·         Photographs or supporting evidence where available

·         Police reference numbers if applicable

The completed form must be returned to VDub via the designated email address or submitted in person at the end of the hire.

Failure to complete and return the Incident Report Form may result in delays to the security deposit refund and could affect insurance coverage

VDub may request additional information if required to process the incident.

 12. VIOLATION OF TRAFFIC LAWS AND REGULATIONS

Driver(s) are personally liable for all legal penalties and fees pertaining to any traffic violation infringements under the current Road Traffic Legislation applicable in the United Kingdom including Northern Ireland and the Republic of Ireland.

 13. CONDITIONS OF HIRE

VDub Adventure’s camper van Rental Agreement/T&C’s is the sole contract for hiring the vehicle between VDub Adventures and the hirer(s), driver(s) and/or passenger(s).

o    VDub Adventures takes no responsibility for any delay, loss, damage or injury that a hirer might experience no matter how it is caused or by whom.

o    No refunds are payable on accommodation or if the Camper is not available

o    These conditions cannot be varied or altered or waived by any employee or representative of VDub Adventures or by anyone providing services or facilities.

Milage allowance is 120 miles per day.  Over and above this is charged at £1.00 per mile.  Please notify in advance if required.

VDub Adventures cannot be bound by any representative or statement unless it is confirmed in writing by VDub Adventures management.

Title to Vehicle

The Hirer acknowledges that VDub Adventures retains title to the Vehicle and that the Hirer possess the goods as a mere bailee only and do not have any right to pledge VDub Adventures credit in connection with the Vehicle and agree not to do so and shall not agree, attempt, offer or purport to sell, assign, sublet, lend, pledge, mortgage, let on hire, or otherwise part with or attempt to part with the personal possession of or otherwise deal with the Vehicle.

Please note:

o    Any changes to this agreement must be in writing and must be signed on behalf of VDub Adventures and by the Hirer.

o    This agreement shall be governed by Scottish Law

o    This Agreement, constitutes the entire agreement of the parties and there are no other oral undertakings, warranties or agreements between the parties relating to the subject matter of this agreement.

o    VDub Adventures reserves the right to add or amend any rental charges without prior notice.

I hereby agree that information provided is correct and agree to all the term of the Rental Agreement above and confirm that Vehicle Condition Report was correct at the time of hire.
